You agree to be bound by all our terms by accessing our site or engaging our crews for 24/7 DOB-compliant sidewalk shed and scaffolding installations.
1. Scope of Services
Emergency Sidewalkshed provides specialized construction and safety services, including but not limited to:
- Emergency Sidewalk Shed Installation: Rapid deployment for DOB violations and unsafe facade orders.
- Scaffolding Rental and Installation: OSHA-compliant systems for residential and commercial buildings.
- Specialized Access Solutions: Pipe scaffolding, suspended scaffolding, and frame scaffolding.
- Site Security: Temporary construction fencing and Jersey barrier rentals.
We operate as a licensed DOB-registered contractor. All work done by our staff complies with Chapter 13, Section 3309 of the NYC Building Code and OSHA safety standards.
2. Emergency Response and Site Access
When you request 24/7 emergency services, you agree to
- Authorize our field teams to perform site measurements, photograph hazards, and assess structural risks.
- Let our team enter the sidewalk and building perimeter to install galvanized steel frames and protective decking.
Note: We are not responsible for delays caused by restricted site access, extreme weather conditions, or NYPD/FDNY interference during emergency deployments.
3. Compliance and Permitting
We facilitate all legal filings through the DOB NOW portal to resolve active violations and restore your site to good standing. Our team manages the technical submission process, but legal compliance remains a shared responsibility between the contractor and the property owner.
- Accuracy of Property Records: You must provide site details, e.g., Borough, Block, and Lot (BBL) numbers, along with copies of all active DOB violations or ECB summons. Our filings rely on the data you provide; incorrect information can lead to permit rejection or continued daily fines from the City.
- Engineering and Professional Sign-Off: We coordinate with Licensed Professional Engineers (PEs) to secure required stamps for complex or high-load structures.
By engaging our services, you agree to follow the specific load limits and structural recommendations outlined in the engineered drawings to maintain public safety in the right-of-way.
- Permit Maintenance and Expiration: You are responsible for requesting renewals or extensions unless you explicitly contract us to provide ongoing permit management and renewal services.
4. Client Responsibilities
As the property owner, manager, or authorized agent, you agree to:
- Immediate Notification: Inform us immediately of any changes to the building’s structural status or new DOB notices.
- Site Security: Maintain the integrity of the sidewalk shed or scaffolding system after installation.. You must not alter, move, or dismantle any components provided by Emergency Sidewalkshed Rental
- Safety Protocols: Make sure that third-party contractors working on your site follow OSHA Competent Person oversight when using our scaffolding systems.
5. Payments and Financial Terms
- Estimates: We provide project estimates following an initial site assessment. These estimates reflect building height, sidewalk width, and the duration of the installation.
- Emergency Mobilization Fees: Emergency deployments may incur mobilization fees due to the rapid dispatch of labor and materials.
- Invoicing: We outline payment terms in your specific service contract. Late payments may result in the suspension of permit renewals or a delay in the removal of equipment.
6. Liability and Insurance
Emergency Sidewalkshed maintains $1M liability coverage and ensures an OSHA Competent Person is present on every active site.
- Indemnification: You agree to indemnify and hold harmless Emergency Sidewalkshed from claims arising from pre-existing structural failures, falling debris from unmaintained facades, or unauthorized use of our equipment by third parties.
- Structural Risks: Our systems are built to protect pedestrians, they do not fix underlying facade issues like loose brick or cracked cornices, but provide the legally required protection until repairs begin.
7. Rental Equipment and Removal
All sidewalk shed components, scaffolding, fences, and Jersey barriers remain the property of Emergency Sidewalkshed.
- Rental Period: The rental period begins upon the completion of installation and sign-off.
- Equipment Care: You are liable for any damage to the equipment caused by vandalism, misuse, or third-party construction activity.
- Removal: Once the DOB violation is cleared or construction is complete, you must notify us to schedule removal. We require a minimum lead time for removal to coordinate logistics and permit closures.
8. Prohibited Use of the Website
You can’t use our website to:
- Submit fraudulent emergency requests or false property data.
- Attempt to bypass our security or scrape technical data regarding our installation workflows.
- Impersonate property owners or agents to gain access to compliance records.
9. Modifications to Terms
We reserve the right to update these terms at any time to reflect changes in NYC Department of Buildings (DOB) regulations or insurance requirements. We will post the revised date at the bottom of this page. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms are governed by the laws of the State of New York. Any legal actions related to our services must be filed in the courts of the county where the work was performed (Manhattan, Brooklyn, Queens, Bronx, or Staten Island).
